221g Denial at US Embassy in Bangkok, is it Final?

221(g) VISA DENIALS FINAL?

In some instances, yes but it depends on the unique set of facts in your case. If you were given a “blue sheet” then quite simply it means a denial with the opportunity to submit more evidence. Once you provide the additional evidence requested, your case may be approved.

A 221g denial denotes the corresponding section of the United States Immigration and Nationality Act. It is officially classified as a denial by the State Department. Usually, this type of request is simply issued to fulfill evidentiary requirements of the visa application. The Consular Officer generally issues such a denial if there is insufficient documentation to render an opinion in the case. In most cases, if the deficiency is remedied, then the visa will be issued.

If you were given a 221(g) denial that saids: “Your petition has been returned to the USCIS Service Center for review and possible revocation,” then your case may no longer be at the Consulate. Your loved ones in the US will have to prove up your relationship by providing more evidence of the bona fideness in your case.

VISA DENIED, NOW WHAT?

Gather all your evidence and speak to a competent and qualified American Immigration Lawyer in Bangkok.

If your loved ones convinced USCIS Service Center that your relationship is genuine, USCIS will approve your petition again and will go through NVC the same way as before. Eventually, you will get to interview again at the US Embassy in Bangkok. When the US Embassy returned your petition to USCIS, it explained to USCIS the reasons and if USCIS is not persuaded by the reasons, it can re-approve your petition and the US Embassy is not allowed to send it back again for the same reason.

However, it is very important that you present a good case to the USCIS to prove your relationship. If you do not put on a persuasive and compelling case, then the Consulate officer's denial will be final.

If you are lucky and you have passed the US tourist visa interview, you will be granted the visa .The passport will be stamped with the visa and the rest of the documents will be returned. But there a times that even though you give it your best effort and are also well-prepared, you may be denied getting a visa. A letter will be sent to you with a reason why you were denied a visa. However you can always apply again and be certain to resolve the issues that led to the prior rejection.
